Power Beyond Position

Workplace Harassment, Informal Authority, and Corporate Accountability in Japan

Power Beyond Position cover

A retired senior employee returns under a new reporting line. The organization chart says one thing; longstanding connections, expertise and informal loyalty say another. Who actually holds power, and when does resistance become impossible?

Japanese law has an answer, and it is more capable than most managers realize: workplace superiority is assessed functionally, not by job title. A person with no managerial rank at all can hold it, and the courts have said so.

But the law's machinery runs on complaints, and the complaints mostly never come. In the most recent national survey, fewer than one worker in twenty who experienced power harassment used the consultation desk every employer in Japan is legally required to provide. Two-thirds of those who stayed silent said nothing would be solved whatever they did. Where employers did know, more than half did nothing in particular.

Power Beyond Position sets out the statutory framework, works through the decided Japanese cases, and confronts that reporting gap directly. It argues that Japanese employers have bought compliance without buying protection, and it shows what closing the gap would actually require of employers, boards, policymakers and managers.

Inside:

The three-element legal test and the six official categories, anchored in real decided cases

Why informal authority escapes supervision, and how to diagnose it

The re-employed returner: the situation that prompted the book

A dedicated chapter on the reporting gap, built on government survey and compensation data

A table of Japanese cases, a role charter, a model policy, a complaint-intake record and an investigation protocol

Written for managers, HR and compliance professionals, employment-law students, worker advocates, expatriate professionals in Japan, and readers interested in Japanese corporate governance.
